Elkin Music Terms of Service

Sales Orders

A) Orders placed at this website are firm orders and may not be canceled.
B) All goods remain the property of Elkin Music International, Inc., until payment in full is received.
C) Claims must be made in writing within 30 days of invoice date.


Payments

Wholesale Clients
A) Established customers are supplied on open account with terms of 30 days net, subject to the account remaining in good standing.
B) Payment may be made by check in U.S. dollars drawn on a U.S. bank; by wire transfer (banking details will be provided upon request and a processing fee of $25.00 will be assessed); by postal money order; or by credit card (Visa, MasterCard, American Express).
C) Orders will be held pending payment of invoices 30+ days past due.
D) Late payments are subject to an annual interest rate of 18%.
E) Habitually late payments will necessitate a review of our terms of trade.
F) New wholesale customers are subject to credit verification before an open account is established.


Retail Clients
A) All website orders must be submitted with valid credit card information (Visa, MasterCard, American Express).
B) Credit cards will be charged at the time of invoicing/shipping.


Pricing

A) Suggested retail prices as reflected on our invoices are established by Elkin Music International.
B) Prices are subject to change without notice and may or may not be accurate where found on this website. If you are concerned about prices, please contact us prior to placing your order.


Discounts

General Discount Information
A) Wholesale customers receive the best available discount, subject to the account remaining in good standing.
B) Retail customers will receive a 10% discount on website orders for products which qualify for discounts. We are unable to offer a discount to retail customers for books on music.
C) Because of the extensive scope of products that we sell, it is impossible for us to provide a simple discount schedule. A general discount schedule follows, but there may be exceptions on certain items such as clothbound editions, archive copies, limited editions, etc. In rare instances, items are sold at a net cost. If you have questions or concerns about our discounts, please do not hesitate to contact us.
D) Discounts are based on the suggested retail price established by Elkin Music International.
E) Wholesale discounts vary according to publishers and according to the quantity-per-title.


Wholesale Discounts for Barenreiter, Breitkopf & Hartel, Bosworth, Brichtmark Music, Hofmeister, Lengnick, Partitura-Verlag, St. Francis Music, Thames Publishing, Zerboni, and Zimmermann-Frankfurt
A) 33% discount for fewer than 3 copies of the same item (fewer than 15 copies of choral octavos / choral scores).
B) 40% discount for 3+ copies of the same item (15+ copies of choral octavos / choral scores).
C) 33% on all full scores and orchestral instrumental material, regardless of quantity.


Wholesale Discounts for For Allans, Amadeus, Ashdown, Curwen, Doblinger, Fentone, Melos/Ricordi B.A., Musica Rara, Nova Music, Zanibon, and for the majority of other foreign publishers
a) 25% discount for fewer than 3 copies of the same item (fewer than 15 copies of choral octavos / choral scores).
b) 30% discount for 3+ copies of the same item (15+ copies of choral octavos / choral scores).
c) 25% discount on all full scores and orchestral instrumental material, regardless of quantity.


Other Wholesale Discounts
A) For most domestic publishers and for a few small, foreign publishers with whom we have limited contact, the maximum discount is 20% regardless of quantity.
B) Discounts on books on music vary according to publisher and quantity per title, with a discount break usually extended for 10+ copies on most titles. For the discount on a specific title, please do not hesitate to contact us.
C) Advertised special offers will be sold at an additional discount above the normal discount for those products.
D) We regret that we are unable to offer a discount on any order totaling less than $15.00 net.


Shipping

A) Unless otherwise requested by the customer, domestic shipments are insured and shipped by UPS Ground service, with charges based on published UPS rates, and with Elkin assuming responsibility for loss or damage in transit.
B) Unless otherwise requested, international shipments are insured and shipped via airmail post, with charges based on published USPS rates, and with Elkin assuming responsibility for loss or damage in transit.
C) Requests for shipment by uninsured, untraceable methods will be honored at the buyer's risk.
D) Sometimes an order cannot immediately be filled and shipped in its entirety, such as when the order may include both stock and non-stock items. Elkin has historically acted judiciously in determining whether more than one shipment is in the customer's best interest, taking into account both shipping costs and timely delivery. If you have a preference (i.e., ship items as they become available, or hold the order until it is complete), we are happy to accommodate your request as best we can.


Minimum Orders

A) Elkin does not assess a minimum order fee.
B) We regret that we are unable to offer a discount on any order totaling less than $15.00 net.
C) Because of the unfortunate practice of illegal photocopying, choral octavos and choral scores may be subject to a minimum quantity, depending on the publisher.


Backorders & Out of Stock Items

A) Backorders are titles not yet published or titles in reprint, with no known release date. Orders for such items will be acknowledged and canceled.
B) Although we maintain a large stock, we do occasionally run out of stock titles temporarily. Items which are temporarily out of stock will be supplied as quickly as possible.


Orders for Domestic Products

A) Domestic products other than those from the Brichtmark Music and St. Francis Music catalogs are not stocked at Elkin and must be obtained from the publishers, with delivery averaging about two to three weeks. Options for expedited delivery at additional cost are available. Contact us for more information.
B) Brichtmark Music and St. Francis Music publications are all in stock and available for immediate delivery.
C) Under no circumstances can orders for non-stock domestic titles be canceled.


Special Imports

A) Special imports are items which are not stock items but which will be supplied from abroad in a timely fashion, normally within four to six weeks. There is no additional charge for this service except when the customer requests expedited delivery. Costs for expedited delivery depend on various factors, including weight and the method of delivery. Elkin cannot guarantee delivery by any specific deadline. If you have questions about the cost or time-frame for delivery, please contact us to discuss your delivery options.
B) Certain items and certain publishers can be more difficult to supply than others and can potentially take weeks or months to arrive. In keeping with our mission of going "to the ends of the earth" for the music you need, we continue to try to obtain all special import titles for a period of up to six months or until we determine that the music is unavailable. We suggest that you contact us for a status report in the event any special import you have ordered has not arrived within eight weeks.
C) Under no circumstances can orders for special import titles be canceled.


Stock Orders & New Issues

A) Elkin does not offer nor require stock orders with special discounts and terms. However, wholesale customers are offered advantageous discounts on orders for three or more copies per title of most printed music products and ten or more copies per title of most books. B) Elkin does not require new issue subscriptions to qualify for our best possible discounts. However, new issues from around the world are advertised regularly with promotional discount offers. See the New Products page of our website for the latest new products from Elkin.


Returns & Replacements

A) We regret that under no circumstances are we able to accept the return of goods correctly supplied to a firm order.
B) Although we make every attempt to fill orders correctly and expediently, mistakes are occasionally made. Goods supplied incorrectly by Elkin will be replaced with the correct item and with no additional shipping charges to the customer. When the cost of the correct item differs to that of the incorrect item, the appropriate credit or charge will be assessed accordingly.
C) Goods lost in transit or received in defective condition which compromises their use (i.e., missing pages, incorrectly collated pages, misprints, etc.) will be replaced as quickly as possible at no additional cost to the buyer if the shipment was insured. Slightly bent corners or other minor bends in printed music is not unusual, especially with items which have been imported from abroad, and these slight imperfections are not considered to be defects. Customers who request uninsured shipments are responsible for loss or damage in transit. (Please see SHIPPING SECTION above.)
